Family and Spouse Visas

If you are a UK citizen or have settled status, and your family or spouse want to join you in the UK, you may need to apply for a family visa. At Immigration Law we understand how daunting the process may seem.

Thanks to years of experience in this field we can offer clear advice to guide you through from start to finish. We will advise you on the different visa routes available for families and spouses and will suggest the appropriate action based on your circumstances to offer you the help and support you need.

Who is eligible for a Family visa?

To be eligible for a Family visa you will need to:

  • Demonstrate you are married or in a civil partnership (or prove you have lived together as unmarried partners for at least 2 years)
  • Show payslips/savings to confirm you earn at least £18,600 a year
  • Offer evidence to demonstrate you are in a genuine relationship
  • Evidence that you intend to live together permanently in the UK
  • Prove your family/spouse meet visa English language requirements
  • If you are not married or in a civil partnership, you may still be eligible to apply for a fiancé visa. We can advise on the most suitable visa option for you, based on your situation.

How to apply for a family visa

Our immigration solicitors can help you and your family identify the documentation needed to make an application. Once they have been collected and checked, we will submit them to the Home Office in the correct format for you.

First-time applicants with families living outside the UK will need to complete the online application form in their home country. The application process can take up to 12 weeks and fast-track options are available at an additional cost in some countries.

If the application is successful, the family visa will be valid for 33 months. Visa holders will then need to apply for an extension once the 33 months have expired. Immigration Law can also help with visa extension applicants to make the process easier to manage.
